RADA SAFARIS USER TERMS OF SERVICE

Thank you for using Rada Safaris!
These Terms of Service (hereinafter “Terms”) are a binding legal agreement between
you and Rada Safaris Ltd, Rada Wallet that govern your right to use the websites and
applications for the “Rada Safaris ltd” service.)
All references, “Rada,” “Rada Safaris ltd,” “Rada Wallet,” “we,” “our,” or “us” refer to
or relate to the entity set out in the title to these Terms.
1. Scope of Services
We are a specialized-travel focused company offering tailor-made safari and curated
group tour experiences, providing an online platform that enables users, search for,
explore listings, save for experiences, and book desired services. You must register an
account to access and use features of the Rada Safaris online platforms, and you
should endeavour to keep account information accurate. Users can explore listings,
book options availed by Service Providers (Hosts), that publish, offer activities,
excursions, and events (collectively referred to as “Host Services”.)
Both parties, “Travellers” and “Hosts” may collectively herein be referred to as
(“Members”). Travellers are informed that Rada Safaris does not own, control, manage
any listings or services presently. Rada Safaris is not a party to the contracts entered
into directly between Hosts and Travellers save as provided under the section covering
Rada Safaris role in these terms of service.
We maintain other Terms and policies that supplement these Terms of service like
our Data Privacy, Protection, Retention and Security Policy which describes our
collection and use of personal data, and our Payments Terms, which govern any
payment services provided to members by Rada Safaris.
Searches.
You can search for services on our website or on the Rada Safaris app by using various
criteria. Travel destination, travel dates etc. You can also use filters to refine your
search results. Our search results are based on their relevance to your search and
other criteria like availability, popularity, previous trips, saved listings and more. Your
search results may appear different on the website vis a vis on our mobile application.
We may also allow our members to promote their listings in the search feature or
elsewhere on our platforms upon payment of a stipulated charge. More information
on how we handle promoted content can be attained through contacting us as
described in the contact us section or reaching out to our customer care service.
Booking and Booking Modifications
Bookings made in regard to listings on the platform are all accepted subject to
availability of the required host service by the requested Service Provider. When you
place a request for booking any available listings, you agree to pay all charges for the
said booking or any options that maybe selected in the checkout process. Rada Safaris
may charge the Payment Method provided in the payment Terms to secure booking
of any service of your preference. The charge applied on the provided payment
method provided by a Guest includes applicable charges or taxes if any and this is
collectively referred to as the (“Total Price”.) Upon your receipt of the booking
confirmation, a contract is formed directly between you and Service Provider.
In addition to these Terms, once booking of a listing is confirmed, you are responsible
for complying with all Terms of the reservation made with the Service Provider,
including without limitation, any other standards, policies, or requirements that apply
to your reservation save for their cancellation policy. It is your responsibility to read
and understand these requirements prior to using our service.
Booking Modifications. Travellers and Service Providers are responsible for any
booking modifications they agree to make via the Rada Safaris Platform or direct Rada
Safaris customer service to make on their behalf ("Booking Modifications"), and agree
to pay any additional amounts, fees, or taxes associated with any Booking
Modification.
Cancellations, Refunds, Travel Issues.
To the extent permitted by applicable Ugandan law, Rada Safaris operates a zero-
refund policy on all payments charged to the payment method provided save for
situations where Total Price charged to the said payment method are in excess of the
quoted price to place the booking/ reservation. You recognise and agree that neither
you, your affiliates, nor anyone claiming under your booking/reservation, shall be
entitled to refunds from us under any circumstances (save for exceptions listed herein)
once bookings/reservations with your desired Host Service Provider have been
concluded.
2. GENERAL TERMS
Rada Safaris Role and Limitations on liability.
We offer tailormade individual safari and group-tour experiences also providing you
the right to use our website and app platform enable you search for, book, explore,
provide host services. You acknowledge that Rada Safaris does not have any
obligation, to verify information provided by Service Providers on our platform. Rada
Safaris does not own, control, manage any listings or Service Providers presently.
Rada Safaris is not acting as an agent for any host except for where we act as a
Payments collection agent as provided in the Payments Terms.
Limitations on Liability.
Our obligations only extend to curating travel experiences and transmitting payments
as and when made to Hosts/Service Providers as agreed herein or in our payment
terms. Neither Rada Safaris (including its affiliates and personnel) nor any other party
involved in creating, producing, or delivering the Rada Safaris Platform will be liable
for any incidental, special, exemplary or consequential damages, including lost profits,
goodwill, or for any damages for personal or bodily injury or emotional distress arising
out of or in connection with (i) these Terms, (ii) the use of or inability to use the Rada
Safaris Platform or any Content thereon, (iii) any communications, interactions or
meetings you may have with someone you interact or meet with through, or as a
result of, your use of the Rada Safaris Platform, or (iv) publishing or booking of a
Listing, including the provision or use of Host Services, whether based on warranty,
contract, tort (including negligence), or any other legal theory, and whether or not
Rada Safaris has been informed of the possibility of such damage, even if a limited
remedy set out in these Terms is found to have failed of its essential purpose.
Member Accounts.
You must register an account to access and use many features of the Rada Safaris
Platform. Registration on the platform is only permitted to legal entities, partnerships
and natural persons aged 18 years or older. You must provide accurate, current, and
complete information during registration and keep your account information up-to-
date. You are responsible for maintaining the confidentiality and security of your
account credentials and may not disclose your credentials to any third party.
Service/Handling Fees.
Rada Safaris may charge, commission, service/handling fees (and taxes applicable if
any) to Host Service Providers and Travellers for the right to use the Rada Safaris
Platform. These fees are non-refundable. We also reserve the right to change such
fees at any time, and will provide members notice of any such changes before they
become effective. Changes in these fees will not affect reservations and bookings
made prior to the effective date of the fee change.
Notice.
Unless specified otherwise, any notices or other communications to Members
permitted or required under this agreement, will be provided electronically and given
by Rada Safaris via email, Rada Safaris platform notifications, messaging service
(including SMS), or any other contact method we enable and you provide.
You will receive administrative communications from us using the email address or
other contact information you provide for your Rada Safaris account. You may also
receive promotional emails from us. No fee is charged for these promotional emails,
but third-party data rates could apply. You can control whether you receive
promotional emails using the notification preferences in your account or in your device
settings.
User Content and Reviews.
Parts of our platform may enable you to provide feedback or reviews in various forms
i.e. text, photos, audio, video, information collectively referred to as “User Content”.
Please ensure that reviews are respectful, accurate and do not contain offensive
language. (Reviews are not verified by Rada Safaris.)
By providing User Content in whatever form, you grant Rada Safaris a non-exclusive,
royalty-free and transferable license to copy, modify, distribute, publish and otherwise
exploit, the said User Content without limitation. If User Content includes personal
information, our privacy policy describes how we use that personal information. You
are solely responsible for all User Content that you provide and warrant that you either
own it or are authorized to grant Rada Safaris the rights described in these Terms.
You are responsible and liable if any of your User Content violates or infringes the
intellectual property or privacy rights of any third party.
Third-Party Services.
The Rada Safaris Platform may contain links to third-party websites, applications,
services or resources (“Third-Party Services”) that are subject to different terms and
privacy practices. Rada Safaris is not responsible or liable for any aspect of such Third-
Party Services and links to such Third-Party Services are not an endorsement.
Disclaimer of Warranties.
We provide this Platform “as is” without warranty of any kind, express or implied and
we disclaim all warranties. For example: (i) we do not endorse or warrant the
existence, safety, quality, legality or suitability of any Service Provider, Listing or third
party; (ii) we do not warrant the performance or non-interruption of the Rada Safaris
Platform. (iii) Presence of a Listing on our platform indicates only that the Member or
Listing on our Rada Safaris platform has completed the account set up process and
basic verification, nothing else. The disclaimers in these Terms apply to the maximum
extent permitted by law. If you have statutory rights or warranties we cannot disclaim,
the duration of any such statutorily required rights or warranties will be limited to the
maximum extent permitted by law.
Dispute Resolution
By agreeing to these terms, it is accepted that in the event of any legal action brought
against us by any party to these Terms, Rada Safaris shall initially be informed of the
Users grievance and be given a chance to solve the same amicably. If the grievance
persists and needs alternative resolution, such shall be firstly be sought to be resolved
through reference to arbitration. The arbiter of preference in these matters shall as a
first choice be the Centre for Dispute Resolution (CADER)
3. MISCELLANEOUS
Interpretation Clause.
Except as they may be supplemented by additional terms, conditions, policies,
guidelines, standards, and in-product disclosures, these Terms (including those items
incorporated by reference) constitute the entire agreement between Rada Safaris and
you pertaining to your access to or use of the Rada Safaris Platform and supersede
any and all prior oral or written understandings or agreements between Rada Safaris
and you. These Terms do not and are not intended to confer any rights or remedies
upon anyone other than you and Rada Safaris.
Where the word “will” is used in these Terms it connotes an obligation with the same
meaning as “shall.”
Assignment
You may not assign, transfer or delegate this agreement or your rights and obligations
hereunder without Rada Safaris prior written consent. Rada Safaris may without
restriction assign, transfer or delegate this agreement and any rights and obligations
hereunder, at its sole discretion, with 30 days’ prior notice.
Waivers.
Rada Safaris failure to enforce any right or provision in these Terms will not constitute
a waiver of such right or provision unless acknowledged and agreed to by us in writing.
Except as expressly set forth, in these Terms, in Ugandan law to constitute an express
waiver. The exercise of any remedies under these Terms will be without prejudice to
other remedies under these Terms or otherwise permitted under Ugandan law.
Force Majeure.
Rada Safaris shall not be liable for any delay or failure to perform resulting from cause
outside its reasonable control, including, but not limited to, acts of God, natural
disasters, war, riots, acts of civil or military authorities, fire, floods, accidents,
pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel,
or labour.
Severability Clause.
In the event that any portion of these Terms is deemed illegal or unenforceable, such
provision will be severed and the remainder of the Terms will remain with full force
and effect.
Survival.
Parts of these Terms that by their nature survive termination, will survive termination
of this agreement.
Modification.
Rada Safaris may modify these Terms at any time. When we make material changes
to these Terms, we will post the revised Terms on the Rada Safaris website and update
the “Last Updated” date at the top of these Terms. We will also provide you with
notice of any material changes by email at least 30 days before the date they become
effective. If you disagree with the revised Terms, you may terminate this agreement
immediately by halting use of our platform and deactivating your account. If you do
not terminate your agreement before the date the revised Terms become effective,
your continued access to or use of the Rada Safaris services will constitute acceptance
of the revised Terms.
